Terms of Service

The Amazing Team Challenge (TATC, we) reserves the right to amend these terms and conditions and such amendments may be made without prior notice at the sole discretion of TATC.


Definitions

Any reference to TATC throughout these terms includes any related body corporate or subsidiary.

Event means the combination of activities organised and facilitated by TATC on the event date in their entirety.

Event Date means the requested and confirmed date for the event activities to take place.

Client means the person or organisation to whom the TATC invoice will be directed, who is responsible for the payment of the same.


EVENT BOOKINGS AND CONFIRMATION:

Bookings are made by a prospective Client (you), in writing, via email or via the contact page on the TATC website with Client’s chosen date, preferred start time, preferred run time and number of participants.

TATC will then email the Client, to the email address used to contact TATC, or otherwise nominated, a confirmation pack with all the details including date, locations, venues, start time, finish time, number of participants, program choice, and event cost. The completed return of the confirmation email by the Client will result in an invoice from TATC being issued. This invoice will be delivered by email. The event is considered to have been confirmed once the invoice is paid in full. Should any changes to the event be required after the fact, TATC reserves the right to re-estimate the event costs, and issue a new invoice.


online events:

For teams working remotely, and particularly during times of Covid-19, TATC may run an online Team Building Event for the Client. In this case, the following Terms of Service apply:

  • Event Bookings and Confirmation

  • Event Payment

  • Cancellations

  • Rescheduling

  • Running to Schedule on the Day

  • Participant and Client Responsibilities (specifically relating to the final paragraph regarding behaviour)

  • Event Content

  • Loss or Damages

  • Force Majeure

  • Privacy


EVENT PAYMENT:

Unless otherwise specified by TATC in the booking confirmation form, the following conditions of payment apply:

Once the full payment invoice is issued, payment is due no less than 15 working days before the Event Date

TATC issues invoices and requires an EFT as a form of payment. This is to ensure protection and privacy of sensitive information and to avoid unnecessary transaction fees and additional costs. 

7 calendar days prior to the Event Date, TATC will be in touch via the contact details provided to confirm the final number of participants for the event. Any additional participants above the original quote will be added to the cost of the Event and sent via a separate invoice. This invoice is due prior to the Event date, if not paid the additional participants will not be allowed to participate in the Event. On the day of the Event, if participation numbers exceed that of the agreed and paid amount, another invoice will be issued to cover any additional participants. 

Events will be charged at the minimum spend fee, or at a price per head, whichever is greater. TATC reserves the right to modify the minimum spend fee at any time.


CANCELLATIONS:

Bookings cancelled within 1 month of the date of the event, will incur a 50% charge of the final invoiced fee.

Bookings cancelled within 15 working days of the date of the event, will incur a 75% charge of the final invoiced fee.

Bookings cancelled within 5 working days of the date of event, will incur a 100% charge of the final invoiced fee.

Booking cancellation requests must be made in writing.


COVID-19:

TATC will always follow the Covid-19 advice and guidelines depicted by the government in running and operating a live Event. If a lockdown or Government restrictions (including the isolation of TATC staff and/or operators) arise that prevent the Event from going ahead, the Client may reschedule for a later date, within 3 months of the original Event Date. If the Client chooses not to reschedule, or reschedule later than 3 months following the original Event Date, they will forfeit 25% of the fee to cover third party supplier and contractor costs.


RESCHEDULING:

In the situation where a request is made to reschedule the Event with TATC, rescheduling is strictly subject to availability and must be within the 3 months following the original Event Date. If a request to reschedule occurs within 15 working days of the original Event Date, an extra 25% of the fee is added to cover third party supplier and contractor costs. Rescheduling requests must be made in writing.


RUNNING TO SCHEDULE ON THE DAY:

Due to a variety of scheduling and third-party commitments made by TATC for each event, we are required to keep as best we can, to a specific time frame. If the Client or a majority of Event participants are more than 15 minutes late to an event, we may need to shorten it. If the Client or a majority of Event participants are more than 45 minutes late to an event, we may even cancel it in order to meet responsibilities to suppliers, contractors or other clients. In the instance of a cancellation due to Client lateness or no show, Client will forfeit full payment. 


WET WEATHER:

Due to the nature of this Event and the elements beyond TATC’s control in the prevailing weather conditions, matters outside the control of TATC may affect participation in the Event. This includes but is not limited to  weather, safety and other associated high-risk conditions.  In this occurrence, TATC reserves the right to change the format of the Event, shorten the Event, or cancel the Event if it deems necessary.  


Participant waivers:

At the time of the Event, each participant will be required to sign a disclaimer that indemnifies TATC, its employees, subcontractors, agents or any third party from responsibility for injury, loss, or other damages. The Client or participants can and are free to, seek and obtain personal insurance over and above the cover provided by TATC if deemed necessary by the Client.


PARTICIPANT AND CLIENT RESPONSIBILITIES:

TATC requires all participants to take responsibility for all potential weather conditions and be reasonably prepared on the day, in accordance with the information sent with the event confirmation pack.

TATC is an ethically and environmentally conscious company and will not promote or comply with the usage of single use plastic water bottles or ponchos. We are unable to carry extra water, sun hats, bags or umbrellas so we ask that participants bring their own water and come prepared for all weather conditions.

TATC can supply tablets for an extra cost for teams to use during the event, for groups with up to 7 teams, if the client selects this option at the time of booking. For larger groups with more than 7 teams, participants must bring and use their own personal devices (tablet or phone) to access information and instructions. All participants are responsible for the use and care of their own devices. Only one device is necessary per team in order to take part. In some cases a paper printout may be available if requested by the client.

All participants must conduct themselves responsibly and will comply with all applicable state and federal laws during the course of the event with TATC. Participants will conduct themselves in a pedestrian like manner and in entering into, or accessing public or private lands, premises, paths or roads, participants do so at their own risk at all times and must comply with all applicable laws and regulations.

Any abusive, intolerant, unethical or inappropriate behaviour towards TATC employees, contractors, third parties or any party associated with the Event shall result in an instant cancellation of the event and all funds forfeited. Forfeit or cancellation of the Event shall not limit any recourse or claim that the victim of any such behaviour may have at law.


EVENT CONTENT:

Any media, including photographs and videos taken while on the event, and for the purpose of the event, is to remain the property of TATC. 

Images and/or videos obtained during any event may be used by TATC across any platform, in perpetuity, royalty free and at our discretion. In order to use this content on any commercial or public medium, Client must request TATC permission in writing. In no circumstance may any information be shared, privately or publically, through media or otherwise, that will reveal solutions to activities or challenges involved in the Event. Should you not want your images used in this way, including company branding, you must contact TATC in writing, with your request, prior to the event. 


LOSS OR DAMAGES:

TATC provides a range of equipment and resources for participants to use during the delivery of our events. In the event of damage, other than fair wear, or loss of equipment through participant misuse or neglect, you as the Client accept responsibility on behalf of the participants or employees and your entire party and will be liable for all associated costs for the repair or replacement of such equipment and resources. This includes but is not limited to damage to any equipment rented by your party and set up by you or a third party on the event site or venue. Any damage to TATC equipment that is incurred will result in a charge for same.


FORCE MAJEURE:

Should any reason outside the control of TATC, including without limitation weather or other dangerous conditions, war, strike or any other act of god, force any change, TATC is not held liable for the aforementioned or similar occurrences beyond the reasonable control of TATC.


PRIVACY:

The information provided when contacting TATC regarding an enquiry or booking is necessary for the Event to take place. Any information provided will be used by TATC to facilitate the administration of the Event. If necessary, TATC may disclose your personal information to third parties involved in the Event. The information provided to TATC is used for only the single purpose of fulfilling the Client’s request regarding a specific event. No details are ever shared or sold to third parties and no information is provided to any third party for marketing purposes.

It is voluntary on your part to submit requested personal information, such as your name, the name of your employer or company. TATC may share information with governmental agencies or other companies assisting us in fraud prevention or investigation.
